News From the State

As the result of legislation passed during the 78th Regular session the Texas Commission on Private Security will be moving to the Texas Department of Public Safety facility at 5805 N. Lamar effective September 1, 2003. In the near future we will provide information on our website and also furnish to ASSIST new addresses and telephone numbers.

Many of you are aware that a provision in the legislation transfers many of the Texas Commission on Private Securities administrative functions to the Department of Public Safety; however, licensure and investigations remain a Texas Commission on Private Security function. By the time you read this article things may have changed. In their second called session, the Legislature is considering moving the entire function of the Texas Commission on Private Security under the Department of Public Safety.

Another change that may be implemented by the time you see this article is the ability to renew individual registrations at Texas Online. In addition, recently passed legislation allows for development of a program that will allow original applications to be submitted online. While this is some time away the prospect is exciting.

In June 2003, the Commission passed rule 422.03 which requires a registrant to return items issued by the company or face administrative action against their registration. This rule was supported by ASSIST and is similar to proposed legislation that died in the 78th Session.

Appropriate documentation will be required to pursue a complaint against a former employee and ASSIST has prepared an equipment issue form that will help you in your documentation. When submitting a complaint, use Texas Commission on Private Security form number 023.

Changes to Chapter 1702 will occur on September 1, 2003 based on HB 1769 and SB 1252 and we are working on the implementation of the new provisions. In addition, we are working on the training requirements of HB 1661- the OC spray bill.

The end of the fiscal year is always a busy time. In addition, when you factor in the headquarters move and implementation of new statutes the task seems daunting. Colonel Davis and his staff at the Department of Public Safety are great people to work with and are providing tremendous support and cooperation.

We also appreciate the support we have received from the security industry and the understanding shown to the agency during these extremely busy times.
