Once every seven years or so, the legislature forces each state agency to undergo a process called, �Sunset Review.� During this upcoming session, beginning January 2009, the Private Security Board, and the Texas Department of Public Safety, will both be forced to run this gauntlet. It is called �sunset� due to the fact that it could result in the end of existence for a state agency.

The Sunset Act requires the Sunset Commission, composed of legislators and public members, to periodically evaluate every state agency to determine if the agency is still needed, and what improvements are needed to ensure that state funds are well spent. Based in the recommendations of the Sunset Commission, the Texas Legislature ultimately decides whether an agency continues to operate into the future.

The Sunset review involves three steps. First, Sunset commission staff will evaluate the PSB and, in May 2008, will issue a report recommending solutions to problems found. The Sunset Commission will then meet to hear public testimony on the Board and the recommendations of the Sunset staff. This meeting will likely be scheduled for June 2008. Based on public input and the Sunset staff report, the Sunset Commission will adopt recommendations for the full Legislature to consider when it convenes in January 2009.

During this process ASSIST will have the opportunity to suggest ways in which the mission of the Private Security Board can be strengthened. We may also have to fend off attacks to do away with the PSB entirely, and move the regulation of the profession away from DPS and place us under the Texas Department of Licensing and Regulation.

ASSIST successfully fought to gain a seat at the table with a requirement that at least one member of the Private Security Board be a representative from the private security profession. We are currently working with the Sunset Commission to let them know how important it is that the PSB be continued and that we stay under the regulatory authority of DPS.

Once again, the ASSIST legislative team will need your help more than ever. We must not allow the regulatory advances we have made over the past several years to be wiped out in one act of sunset.
