Legal Decisions:

"Confidential" Crime

The Utah Supreme Court held that when a salesman took company price lists labeled Confidential from the former employer to a competitor, and helped his second employer develop chemical formulas based on specific client data, he was guilty of stealing trade secrets.

The court found that the first employer took steps to limited access, and protect their interests.

Delayed Trauma Compensation

The Iowa Supreme Court has ruled that a convenience store employee who first witnessed a shooting at his workplace, and was then robbed at gunpoint six days later, qualifies for workers compensation benefits, even though he did not begin to experience trauma-related symptoms until a year later. The court found that the unexpected and traumatic events caused unusual strain on the employee.

"Freedom of Speech" Applied to Books

The Colorado Supreme Court has ruled that a bookstore is not required to provide customer information to help police in a drug investigation. Such an action the court ruled would violate an individuals First Amendment rights to buy books anonymously. The Court reversed a jury decision which was based on four issues. First the request was legitimate, there was a strong connection between the matter being investigated and the material being requested, and the information was not available from another source. Finally, the intrusion was limited enough in scope to prevent exposure of other information.
